QME vs. AME: Which Process Applies to You

A QME is a physician certified by the California Division of Workers’ Compensation Medical Unit to examine injured workers and write medical-legal reports. Those reports directly influence permanent disability ratings and benefit decisions. Whether you go through a QME or an Agreed Medical Evaluator comes down to one factor: whether you have an attorney.

Unrepresented workers receive a randomly generated three-doctor panel from the DWC Medical Unit in the relevant medical specialty and choose one physician from that list. Workers represented by an attorney can instead negotiate an AME, a single physician both the attorney and the claims administrator agree upon, bypassing the random panel entirely. When the parties can’t agree on an AME, the QME panel process applies, and each side may strike one name, leaving the remaining physician as the evaluator.

That strike decision matters more than most workers realize. Knowing which physicians tend to write reports favorable to insurance carriers, and which to workers, comes from having worked both sides of these disputes.
